Default Viewing on-line child porn ruled legal in New York

Apparently, in the state of New York on-line child pornography isn’t a crime anymore. Or better still, an appeal court ruled that Internet users can’t be convicted if they just “view” images related to that particular kind of wicked stuff on a Web browser.

The debated decision came from the New York Court of Appeals on the case of James D. Kent, an assistant professor of public administration at Marist College (Poughkeepsie) on whose computer were found, during a virus scan he requested in 2007, child pornography images.

After the uncovering, Kent was convicted for 134 counts of possessing child porn and 2 counts of having “procured” the images. The man was sentenced to a maximum of three years in jail, but the appeal verdict has now reconsidered (and dismissed) one count of possession and two counts of promoting a sexual performance involving kids.

These particular charges, the Appeal judges decided, can’t be upheld because the corresponding images were found within the defendant’s web browser cache. “Merely viewing Web images of child pornography does not, absent other proof, constitute either possession or procurement within the meaning of our Penal Law”, judge Carmen Beauchamp Ciparick wrote in the sentence.

“Rather – the sentence states – some affirmative act is required (printing, saving, downloading, etc.) to show that defendant in fact exercised dominion and control over the images that were on his screen”. The judges agreed on the fact that child pornography is a wicked affair, yet the Court majority didn’t think that criminalizing “all use of child pornography to the maximum extent possible” was required by the laws of NY State.

Web cache aside, professor Kent was still found guilty of possessing about 13,000 child porn images saved in a separate folder of his computer’s hard drive, a fact that the man justified as being part of a research project on the regulation of on-line child pornography.

Smh NY, even if this guy or other child pornographers have any kind or only view them in their web browser it means that this person is yet a child pornographer user/distributor, it makes him accountable for crime- it means that he supply the means of making this kinda stuff ...smh

I saw this on the Factor (O'Reilly) today, and I don't see how she could have ruled otherwise on those particular incidents.

Don't get me wrong, I'm dead set against child pornography, and I think 3 years was way too light a sentence for the 13,000 pictures he had. It should have been 1 year for each of the pictures the pervert had..

But, as a computer professional, I have to agree with her ruling. What happens if I'm out surfing the web, and I accidentally run across this kind of sick s***. It's now in my web cache, so technically I could be found guilty of watching child pornography.

Her ruling just said that, on the ones that were only in his web cache, that being there did not constitute guilt. You had to prove that he had watched them deliberately and hadn't just stumbled on them accidentally. If she didn't rule that way, prosecutors in the future could theoretically convict people just for receiving spam or junk mail that had illegal content.

So, while I have to agree with the ruling itself, I still think the guy should be strung up by his gonads...

EDIT: This guy isn't getting off the hook, just so you know that. The 13,000 pictures were not in his web cache and were not affected by this ruling...

Am neutral on this matter, child pornography is a bridge against the warez community anyway.

I totally agree with this one. If anyone has ever browsed popular forums and image boards you know how many child pornography material just gets thrown around to get people talking. If anyone has ever been to 4chan or any other image board, you probably have some child pornography in your cache. Saving them and looking at them are two different things. I probably have a huge bunch in my cache as well. I used to browse those sites for the quick laugh.

I'm screwed since I'm in Texas though, I'd probably be executed if anyone checked on my cache.

Agreed, I've been on 4chan multiple times collecting garbage and funny gifs/pics.
And I've seen some crazy stuff there, luckily my cache gets cleared everytime I close my browser.

It's not the the law that scares me... It's what happens if my wife ever learns how to look at my cache... Execution would be a picnic compared to what she'd do to me...

I also agree to the ruling as the cache.. is a shared/open resource's
I have seen java trojan from site's installing mail/spambots..or other mall-ware

But the news says : Viewing child pornography online isn't a crime
Well.. I don't agree with that.. this means anyone can go to a Online-cafe and watch cildp0rn in Ny..?? thats just nuts

I'd just call the title sensationalist journalism again, except for one small problem. They are technically right in interpreting the ruling that way.

While I stated that the ruling was the only one a fair judge could make, otherwise a lot of innocent people could end up in jail, there is a down side to it. If there is no other evidence that you were looking at child pornography, then looking at it only in your web browser is not technically a crime. That's because the only evidence against you would be what was in your web cache.

However, you couldn't just walk into an internet cafe and start looking at the stuff. The ruling said "in the absence of other evidence", not "can never be used as evidence". So, if there were eyewitnesses in the cafe who saw you looking at that stuff, that would be the other evidence needed to convict you. Likewise, bookmarking several child porn websites, is also evidence of deliberate intent, whether you save the images to your hard disk or not. Besides, these pervs don't just browse the web. They almost always save copies of the best pics for use later, just in case their favorites get deleted off the web site.

So while it's technically correct, I doubt there'll ever be a case where someone gets off completely free because they only looked at it in their web browser. There'll always be some other type of evidence, and that's what will get those sick SOB's...

Remember a collector never stops collecting.. people download.. they download and save stuff for later viewing.. this is no different.. if anything these perverts are more likely to download and save since its not available in abundance (I hope).. unlike us all they aren't satisfied with tube sites..
So till the police does its work.. there shouldn't be any problem catching the real perverts..
And I haven't heard hackers injecting childporn as virus .. I have seen most hackers wishing these people be caught.. but who knows..
