hey fellow musicians , producers , all of you great forum goers' . =). i have an issue i would like to bring about ..... perhaps i missed this topic if it was coverd somewhere in this 157 paged thread ..... I am a psytrance music producer .....,, non commercial free music , made for the enjoyment of others.... i have a question regarding this Incredable Post.... ive found So many things out of this thread that i would LOVE to take snips, bits , and pieces of ......... so much amazing audio ....... my question is, If i was to sample somthing say from lets just say an " immediate music " track... , then edit whut ever it is into a psytrance music track , then release the track for no cost, free of charge ,, just for enjoyment,, Can i be hassled with copyright infringment laws ? ,, i mean , of course it goes with out saying that making money out of unlicenced scoring material would result in a law sute ,, but do u think i will be out of harms way if i make somthing and release it for free ? please get back to me with thoughts on this ,, i am egar to dig my hands into these samples !!!!!  |

That would be what copyright law calls a derivative work, and there is at least one circuit court ruling that any musical sampling no matter how little requires permission from the copyright owner. So yes, it would probably still be copyright infringement.

Hello there, I'm haunting this wonderful thread once again with little request to our God Spazzer or anyone who could help me :< I'm looking for "Picture Perfect Music - Gothic Impact- voices of the apocalypse" - I've searched this thread but I've found only something named "PM - ghosts of the apocalypse" which don't even want to download honestly [but it's probably that my net sucks not download link] Any help in finding this gem would be appreciated greatly  Simple Edit: Also if it's not a big deal I'm looking for Production Music Series Vol. 55 - Epic Hip-Hop - thank you in advance! Further more.......... my question continues as to....... if all these exclusive works posted here from these major production companies... ,, What are all these people doing with it !?!?!?!?!?!?!?!! ,, surley not all tiddly winks and home movies no? lmao - maybe just listening to them to get an idea of what to purchase?? i really want to make a " Free Derivative work " with bits and pieces taken from all over..... if i end up in court , i will claim " Fair Use" , and how the small samples taken are not the main focal point of the work...... damn this is complicated. can someone please explain to me a way i can make somthing FREE out of these samples , with out going to court over it lol ! I found 60 VideoHelper Tracks in 320kbits, most of them are only available in 128kbits here. But they are from different cds. |

And perhaps the companies of said music as well. This is not the typical music for any audience. Mostly for a select audience. Soundtrack scores are also not widely the top choice for many listeners. There are already plenty of youtube videos featuring samples of the trailer music. And constantly, youtube videos are being taken down for certain companies. The companies also have their "sample suites" as well. If you look at the Two Steps From Hell website, you'll see their 10-minute tracks containing samples from their latest album. And I would think most here do use this just to listen to for the sake of listening to music or use for private-non-public-home videos. Any commercial use would best through the company sites to purchase the rights to use the music without worry of "fair use". " Free Derivative work " would not at all be necessary, as most these companies provide samples on their websites. This is not the sort of music that anyone will pick up after listening to a sample suite. Out of all my friends, only a few listen to this and know of names like Audiomachine. If I were to let my other friends listen, they would like it, but would never think of buying anything. They would still buy "normal" music by artists like Black Eyed Peas, Marilyn Manson, Rob Zombie and anything else on mainstream radio/television. We've had many enthusiasts here in this thread wanting to shout on top the world the splendor of this music, but truthfully, the only ones that will listen are the ones that have already heard of it. There was one enthusiast that played tracks on a radio show and was ordered to cease his efforts by the production companies. I imagine it wasn't a popular radio channel (of all the radio channels in my area, there are only 2 soundtrack channels, but they only get about an hour's time on the classical channel, and come in very fuzzy). But it certainly hit the radar. Your idea of "releasing" sample tracks, you have not specified in what means you wish to "release" these tracks. Through radio? Commercial venues? download sites such this one? facebook?? "low-profile" would be key in avoiding any certain law suites. If you wish to share samples, you can always link to the main sites where samples already exist. Any public broadcasting would most certainly be on their radar. As excited as you are about the music, merely listening to it should be enough... and it would also be low-profile  Sorry, but there really is no solution. But, we still don't know in what manner you wish to "release" these samples. |
